REQUESTS FOR AUTHORIZATION OF A FOREIGN CITIZEN WHO IS RESIDENT ABROAD FOR THE PURPOSE OF ESTABLISHING A RELATION OF DEPENDENT, TEMPORARY, PERMANENT OR SEASONAL WORK

Applications shall be lodged by means of special Forms. They may be lodged only from the date fixed by the decree establishing entry flows for the current year. The decree for 2007 has admitted 80.000 third-country seasonal workers and 2.000 foreign citizens who have joined training and education programs in the origin country.

REQUESTS FOR AUTHORIZATION TO WORK FOR FOREIGN CITIZENS WHO ARE RESIDENT ABROAD AS DISTINGUISHED ACCORDING TO THE SPECIAL WORKING CATEGORIES

provided by article 27, sub.1 of the Single Text which do not fall within the yearly planning of entry flows

• Forwarding of applications for authorization to access work in the particular cases provided by Article 27, sub.1, letters a), b), c), d), e), f), g), i), and r-bis of the Single Text on Immigration shall take place by registered letter with acknowledgment of receipt to be addressed to the Sportello Unico (Single Desk) of the employer's Province of residence or to the Sportello of the Province where the working activity will be performed.
  In any case, the competent Sportello Unico for the issue of the authorization to work shall be the Sportello of the Province where the working activity will be performed. Therefore, in case of a different Sportello, the receiving Sportello Unico shall forward the request to the competent one and inform the employer accordingly. The procedure for the issue of the authorization is similar to the one described before.
• For workers engaged in circuses or wandering shows abroad, artistic and technical personnel for lyrical, theatrical, concert or ballet shows, dancers, artists and musicians to be engaged by entertainments clubs, artists to be engaged by musical, theatrical or movie corporate bodies or by radio or public/private TV enterprises or by public organizations, in the framework of cultural or folkloristic events (for the cases under letters l), m), n) and o) of Article 27 of the Single Text), rather than to the Sportello, applications shall be forwarded to the Direzione Generale del Mercato del Lavoro – Ufficio per il collocamento nazionale lavoratori dello spettacolo, which is competent for the issue of the relevant authorizations
• For foreign citizens to be engaged for any type of professional sport activity in Italian sports companies (letter p) of Article 27), the authorization to work shall be replaced by the declaration of consent issued by CONI (Italian National Olympic Committee) under the worker's name

Communication of the above authorizations and declarations shall be given by the competent Offices to the Sportello Unico for the purpose of establishing a contract of stay for show workers, to the Sportello of the Province where the enterprise is legally seated and, in the case of sport workers, to the Sportello  of the Province where the concerned sport company is seated. In this case, the Sportello is only competent for the final stages of the procedure concerning the signature of the contract of stay and of the Application Form for the permit of stay.

There are no existing provisions concerning permits to be issued for sea workers and correspondents officially accredited in Italy as well as dependent workers regularly remunerated by Italian press organs or periodicals or foreign broadcasting stations – Article 27, letters h) and q) respectively – as well as for dependent workers of diplomatic and consular representations or international law bodies seated in Italy. No procedures are provided at the Sportello Unico in these cases.

STIPULATIONS OF CONTRACTS WITH FOREIGN CITIZENS REGULARLY STAYING IN ITALY

In case of a new contract of stay for dependent work signed by a foreign citizen regularly staying in Italy and an employer - which replaces or integrates the first one (Form Q) - and in case of stipulation of a contract of stay for working relations established before the entry into force of Law 189/2002 and of Presidential Decree 334/04 (Form R), the provisions of the circular of the Ministry of Labour and Welfare (n.9 of 8 March 2005, available on the Internet at the address http://www.welfare.gov.it ) shall be applied.
In these cases the parties shall stipulate and sign independently the contract of stay, to be drawn up on the special Fom and sent to the Sportello Unico by registered letter with acknowledgement of receipt. The Sportello shall return the stamped receipt.
ATTENTION : The return receipt shall be sent to the sender's address. However, since it is to be exhibited by the foreign citizen on the renewal of the permit of stay, apart form the employer's name, the receipt shall bear the foreign citizen worker's name too. The contract shall be filed in the Office, which is entitled to carry out any appropriate checks, as provided by law.
According to Article 36 bis of the implementing Regulation, the obligation to stipulate a contract of stay following the establishment of a new working relation concerns the start-up of any work engagement, even if it follows a former contract.
As regards the changes in the working relations , for which compulsory communication to the Sportello Unico is provided, the employer shall communicate, within five days from the event, the starting and cessation dates of the working relation with the foreign citizen, as well as the worker's transfer of seat with the corresponding starting date.
Forms Q – R

CONVERSION OF A PERMIT OF STAY FOR STUDY OR SEASONAL WORK INTO A PERMIT OF STAY FOR DEPENDENT WORK

A foreign citizen who is holder of a valid permit of stay for study or vocational training and for seasonal work and wants to request a conversion of this permit into a permit of stay for dependent work shall forward to the competent Sportello Unico an application for checking the availability of quotas for dependent work. The contract - to be signed only by the employer (Form Q) - shall be enclosed to the application.
The Sportello shall forward the application to the Provincial Directorate of Labour, which shall check the availability of entry quotas and inform the Sportello on the results. In case of lack of availability of quotas, the Sportello Unico shall inform the foreign citizen accordingly.
In case of availability of quotas, the citizen shall be invited at the Sportello Unico to sign the contract and apply for the issue of a permit of stay for dependent work.
The Sportello shall inform the foreign citizen of the date when the permit of stay may be available.

CONVERSION OF A PERMIT OF STAY FOR STUDY INTO A PERMIT OF STAY FOR DEPENDENT OR SELF-DEPENDENT WORK

In the case of foreign students who have attained the majority age or have got a degree or specialist degree in Italy (Contract Form Q to be enclosed to the application)

• A foreign citizen who is holder of a valid permit of stay for study or vocational training and, after attaining the majority age or getting a degree or specialist degree in Italy, wants to apply for the conversion of the permit into a permit of stay for dependent work, shall forward to the competent Sportello Unico, by registered letter with acknowledgement of receipt, an application for invitation at the competent Sportello for the stipulation of a contract of stay (Form Q) and enclose the contract already signed by the employer.
  After checking the regularity of the contract, the Single Sportello shall invite the foreign citizen for the signature of the contract and of the application for a permit of stay.
• In case of a conversion of a permit of stay for study into a permit for dependent work, a foreign citizen who is in one of the above-mentioned conditions, shall lodge to the Sportello Unico an application (Form Z) for certification proving the fulfilment of the requirements for dependent work, according to Article 6, sub.1 of the Single Text on immigration.
  In this case, checks on the availability of quotas for dependent or self-dependent work for the current year will not be carried out. The number of permits of stay for dependent or self-dependent work, however, shall be cut out of the entry quotas established by the relevant decrees for the following year.

REQUEST FOR CERTIFICATION PROVING THE FULFILMENT OF THE REQUIREMENTS FOR SELF-DEPENDENT WORK

In case of conversion of a permit of stay for study or vocational training into a permit of stay for self-dependent work, applications shall be lodged only when entry flows for the current year are established.
A foreign citizen who is holder of a valid permit of stay for study or vocational training and wants to apply for the conversion of this permit into a permit of stay for self-dependent work shall forward to the competent Sportello Unico an application to be drawn up on the special Form for the issue of the relevant certification. Applications shall be integrated with the documentary evidence indicated in the Form itself, according to the typology of self-dependent work for which the certification is requested.
The Sportello shall forward the request to the Provincial Directorate of Labour, which shall check the availability of entry quotas for self-dependent work and inform the Sportello on the results.
In case of lack of availability of quotas or failure to fulfil the requirements provide by Article 26 of the Single Text on immigration for the exercise of self-dependent work, the Sportello Unico shall inform the foreign citizen accordingly.
In case of availability of quotas, the Sportello Unico shall invite the foreign citizen for the issue of the certification proving the fulfilment of the prescribed requirements and the signature of the application for a permit of stay for self-dependent work.
Finally, the Sportello Unico shall inform the foreign citizen on the date when the permit of stay may be available.
